Injury to a Minor
In New York State, if a person is under the age of 18, he or she is considered a minor, not an adult. Minors cannot sign legal documents, and if a minor is injured in an accident, the parent(s) or legal guardian(s) of that minor are responsible to retain an attorney in order to make a claim for that minor’s injury, and to bring a lawsuit on behalf of that minor.
The law states that a minor’s interests must be protected, and a minor’s personal injury claim cannot be settled without the bringing of a lawsuit. Such a lawsuit is not handled in the same way as a lawsuit for an injured adult. There are specific rules which must be followed, and certain documents which must be filed and submitted to the Court. Any settlements which are to be paid on behalf of an injured minor must be approved during a hearing at the Courthouse. Such a hearing is called an Infant Compromise, and generally includes an appearance by the attorney and the minor, with his or her parent(s)/guardian(s) in attendance, before the Judge handling the case.
